Terms & Conditions
Last updated 2 September 2026.
These terms form part of the agreement between you and James Djordjevic / XPR Visual (“the Photographer”, “we”, “us”) for any photography session you book (“the Client”, “you”). They are provided when you book and apply to every enquiry, quote, booking and session unless we have agreed otherwise in writing.
If you book as a consumer, a private individual not acting for a business, your mandatory rights under Dutch consumer law apply alongside these terms and prevail wherever they conflict. Some clauses below apply differently, or only, to business bookings; these are marked.
In plain terms
- A deposit (the booking fee) secures your date. It pays for holding that time for you and preparing. It is not a deposit against the shoot, and it is not refundable once we have started preparing.
- You can move your session once for free with 48 hours’ notice.
- You can cancel any time. How much comes back depends on how close to the date you cancel; the detail is in clause 4. If you booked for a business, fees paid are not refundable.
- You are booking a style you have seen in the portfolio. Which frames we pick and how we edit them is our call. Not loving the look is not the same as us not doing the job. But if something is genuinely wrong with a file, tell us within 14 days and we will fix it.
- We keep the copyright. You get a licence to use the images for yourself and your work.
- We only show your pictures in our portfolio or on social media if you have said yes in writing.
The full terms below take precedence over this summary.
1. The session
- Sessions take place in and around Amsterdam, outdoors or at a location you choose. We do not work in a studio as standard; a studio, or a location outside Amsterdam, can be arranged on request, subject to availability and to an additional cost agreed in advance.
- We photograph with available daylight and a reflector. Studio lighting and flash are not part of the session.
- The session covers the time and scope set out in your confirmation. Hair, make-up, styling and wardrobe are your responsibility.
- You are responsible for arranging any access, permits or permissions a location requires, and for the readiness and conduct of anyone you bring.
- We may end a session without refund if a participant behaves unsafely or abusively, or is unfit to be photographed, for example through intoxication.
2. Booking and payment
- A date is reserved for you only once we have sent a confirmation and received the payment we have asked for. Until then the time remains available to others.
- Fees are those set out in your quote or confirmation. Amounts quoted to consumers include VAT (BTW); amounts quoted to businesses are stated without VAT, which is added where it applies.
- The booking fee secures your date. It is the fee for holding that time exclusively for you, declining other work for it, and the preparation we carry out beforehand. It is not a deposit held against the shoot. It becomes non-refundable once that preparation has begun, subject to clause 3.
- Anything beyond the booked session, such as additional retouching, extra images from the shoot, a studio or location hire, permits, parking, an assistant, or travel outside Amsterdam, is quoted separately and paid in advance. Once we have committed such a cost to a third party on your behalf, that amount cannot be refunded, because we cannot recover it.
- Payment disputes. If you believe something is wrong with a charge, contact us first so we can resolve it. Starting a chargeback, payment reversal or payment-provider claim without contacting us first, where the session and images have been provided as agreed, is a breach of these terms.
3. Your right to withdraw (consumers)
If you book as a consumer and the booking was made at a distance, by message, email or through this website, you may withdraw from the agreement within 14 days of making it, without giving a reason.
- A session takes place on a fixed date, so by confirming a booking you expressly ask us to begin work, reserving your time and preparing, during those 14 days, and you accept that the right to withdraw ends once the session has taken place.
- If you withdraw before the session, we refund what you have paid, less a proportionate amount for what we have already done at your request: reserving and holding the date, declining other bookings for it, preparation, and any travel or third-party costs already committed.
- To withdraw, send us a clear statement within the 14 days. A message or email is enough.
- This right does not apply to bookings made in the course of a trade, business or profession.
4. Changes, cancellation and non-attendance
4a. Moving your session. You may move your session once at no charge, provided you give at least 48 hours’ notice. Your booking fee carries over to a replacement session held within 30 days of the original date. If no replacement is held within 30 days, or the replacement is itself cancelled, the booking fee is forfeited. A second move may be possible at our discretion and is subject to a rebooking fee of €50. Any further change, or a change on less than 48 hours’ notice, is treated as a cancellation.
4b. Cancelling, consumers. You may cancel at any time. The booking fee is non-refundable once preparation has begun (clause 2), except within the consumer withdrawal period, where clause 3 applies. Where the full session fee has been paid:
- More than 7 days before the session: we retain the booking fee only, and the balance of the session fee is refunded.
- 72 hours to 7 days before the session: we retain the booking fee plus 50% of the balance, and 50% of the balance is refunded.
- Less than 72 hours before the session, or if you do not attend (a “No Show”, clause 4d): the full fee is retained and nothing is refunded.
Any third-party costs already committed on your behalf remain payable in every case. Nothing in this clause removes a consumer’s mandatory rights under Dutch law; where those rights give a better outcome, they apply.
4c. Cancelling, business bookings. For bookings made in the course of a trade, business or profession, all fees paid are non-refundable, except where mandatory law requires otherwise. Third-party costs committed on your behalf remain payable.
4d. Late arrival and No Show. Your booked time still applies. We wait up to 10 minutes; time lost to a late start is taken from the session, so arriving 10 minutes into a 30-minute session leaves 20 minutes. If you do not attend and have not contacted us within 2 hours of the scheduled start time, the booking is a “No Show”: the full fee is due, no images are produced, and any future booking may require a new booking fee.
4e. If we move or cancel. If we have to reschedule or cancel, for example through illness or equipment failure, we offer the earliest workable alternative or, if that does not suit you, a full refund of everything you have paid. Our responsibility for a change on our side is limited to that alternative date or refund.
4f. Weather. Outdoor sessions depend on workable conditions. If weather makes a session unsafe or unworkable, we reschedule it to a new date at no charge; this does not count as your one free move and is not a reason for a refund. A refund applies only if, after reasonable effort, no workable alternative date can be agreed.
4g. If we are delayed. In the unlikely event we are running late, the session moves to a later time the same day.
5. Force majeure
We are not liable for any delay, failure or inability to perform caused by circumstances beyond our reasonable control, including severe weather, transport disruption, acts of government, power or internet failure, illness, injury, theft or failure of equipment, natural disaster, civil unrest, or the failure of a third-party supplier. In such circumstances we may reschedule the session to the earliest reasonably available date without liability. Where no workable alternative date can be agreed after reasonable effort, we refund the fees you have paid for the affected session, less any third-party costs already committed.
6. Delivery
- After the session you receive a selection file, in colour and black-and-white, within 1 to 2 working days.
- Once you have made your choice, the final edited images are delivered as high-resolution JPEG through a download link, normally within 3 to 5 working days of your selection.
- Editing means our standard work on light, contrast, colour and minor skin retouching. More detailed retouching, and additional images from the shoot, are available and quoted separately.
- We do not supply raw (unedited) files.
7. Artistic discretion and acceptance
- You confirm that you have seen the Photographer’s portfolio and are booking on the basis of that style.
- Image selection, composition, framing, colour grading, cropping, retouching and the overall look remain the Photographer’s professional decision.
- A preference for a different editing style, or subjective dissatisfaction with the artistic result, is not a defect in the service and is not grounds for a refund, re-shoot or rejection of the booking.
- If you believe a delivered file has a material defect, for example a technical fault or a departure from what was agreed in writing, tell us in writing within 14 days of delivery. We will correct a genuine defect at no charge.
- After 14 days, the delivered images are treated as accepted and no further claim about the artistic result will be considered. In exceptional circumstances we may, at our discretion, extend this period by up to a further 14 days.
- Nothing in this clause removes a consumer’s mandatory rights in respect of a service that is genuinely not as described, or not carried out with reasonable skill and care.
8. Copyright and how you may use the images
- We retain the copyright in every image at all times.
- On full payment you receive a personal, non-transferable licence to use the delivered images for your own website, portfolio, social media, printed personal use, and, for business clients, your own personal branding and internal use. The licence ends automatically if these terms are breached.
- The licence does not cover: resale, sub-licensing, supply to third parties or stock libraries, paid advertising or campaign use, packaging or merchandise, NFT creation, or use to train or develop artificial-intelligence or machine-learning systems. Any of these requires our written agreement in advance, and, for a specific commission, a wider licence can be agreed in writing as part of the quote.
- You may not pass the images to third parties without our written permission.
- Please credit “Photo: James Djordjevic” wherever a credit is reasonably possible, particularly online.
9. Our use of the images
We use images from a session in our portfolio, on this website, on social media, in competition entries and in other promotional material only where you have given explicit consent, either through a consent option in the booking or by a separate written release. If you have not given that consent, we will not publish or display images of you or your session. You may withdraw consent for future use at any time by contacting us; this does not affect uses already made.
10. Other people in the photographs
Where a session includes people other than the person booking, you confirm that everyone photographed has agreed to be photographed and to the intended use, and will sign a model release where we ask for one. For anyone under 18, consent must come from a parent or legal guardian.
11. Things within your control
We are not responsible for a result that is compromised by factors within your control, including lateness, not following reasonable direction during the session, lack of cooperation, venue or third-party restrictions we were not told about, third-party interference, or inaccurate or incomplete information you gave us. No refund or compensation is due in these circumstances.
12. Keeping your images
We keep the edited images for at least 12 months after delivery and will usually keep them longer, but we do not guarantee indefinite storage; please keep your own backups. Re-supplying images after that period may carry a small handling fee.
13. Liability
- Our total liability in connection with a booking is limited, to the fullest extent permitted by law, to the fees you have paid for that booking.
- We are not liable for indirect, consequential, special, reputational, commercial or economic loss, including loss of profit, business opportunity, anticipated savings or goodwill.
- We take reasonable care in capturing, editing, processing, storing and delivering images. If, through circumstances genuinely beyond our reasonable control, we cannot deliver some or all of the images, our responsibility is limited to re-shooting where practical or refunding the part of the fee for the affected services. In no case does our liability exceed the total amount you have paid.
- Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for intent or gross negligence, or your mandatory rights as a consumer.
14. Complaints
Tell us within 14 days of delivery (see clause 7 for the artistic result) and we will work with you in good faith to put right anything genuinely wrong. If we cannot resolve it, clause 18 applies.
15. Personal data
We handle personal data as described in our Privacy Policy.
16. Changes to these terms
We may update these terms from time to time. The version that applies to your booking is the one in force on the date we confirm it.
17. Severability
If any part of these terms is found to be invalid or unenforceable, the rest continues to apply, and the invalid part is replaced by a valid provision that comes closest to its intended effect.
18. Governing law
These terms are governed by the law of the Netherlands. Any dispute will be brought before the competent court, unless mandatory consumer or EU law provides otherwise.
